Arrêt maladie et maintien de salaire : rappel des règles

  • ghr.fr
  • 12 mai 2025
💸 Since April 1, 2025, the income ceiling considered for calculating French Social Security daily allowances (IJSS) has decreased from 1.8 times the minimum wage (€3,243.24 gross) to 1.4 times (€2,522.52 gross). This reduction obligates employers, who must maintain salary in case of employee sick leave, to pay a larger complementary part. Employees on sick leave receive IJSS from CPAM and salary maintenance from employers, varying by seniority and absence length. Conditions for salary maintenance include at least one year of seniority, providing a medical certificate within 48 hours, and receiving Social Security coverage. Salary is maintained without delay for work accidents or professional illnesses, otherwise, a 7-day waiting period applies. Salary maintenance starts at 90% of gross pay for 30 days, then 66.66% for the next 30 days, with additional days added for every five years of seniority, up to a maximum of 90 days for each period. Employers' additional remuneration takes into account Social Security payments, without exceeding the net pay the employee would have earned if they had worked.

Récompense en échange d’avis clients : est-ce vraiment légal ?

  • Paul
  • 4 mai 2025
📝 In the online reputation race, companies contemplate rewarding customers for reviews, raising legal and ethical questions. Offering rewards—discounts, promotional gifts, gift cards, loyalty points, raffle entries, or exclusive access—might alter the perceived objectivity of reviews. French consumer law (article L. 121-2) deems deceptive any false or misleading commercial practice, including on product characteristics or pricing. Norms like NF Z74-501/ISO 20488, while voluntary, dictate genuine consumer reviews without compensation. Legal sanctions for deceptive practices can reach €75,000 for individuals and €375,000 for legal entities, with additional penalties including imprisonment. Online platforms like Google Business Profile may remove reviews or profiles and reduce search visibility for rule violations. Guest Suite's strategy avoids incentivizing reviews, suggesting automated customer solicitation and satisfaction surveys as alternative approaches for authentic feedback. Guest Suite claims to boost client reviews by 200%, with 90% positivity, via unlimited surveys and automated review collection, including AI responses.

Taux de cotisation AT/ MP applicables à compter du 1er mai 2025

  • ghr.fr
  • 2 mai 2025
🛑 The 2024 accident at work and occupational disease (AT/MP) contribution rates in France were extended until April 30, 2025, due to late passage of the 2025 social security budget. On April 29, 2025, an order was published setting the AT/MP rates effective May 1, 2025, with no retroactive effect. The 2025 rates are based on the company's 2023 workforce. Companies with fewer than 20 employees follow a collective rate; for 2025, the collective rate for restaurants and similar establishments is set at 2.03% in Haut-Rhin, Bas-Rhin, and Moselle, and 1.85% elsewhere. Individual rates include four additional levies: M1 at 0.18%, M2 at 56%, M3 at 0.19%, and M4 at 0.03%. Personalized rates for 2025 are accessible online for employers.

‼️Juridique, Gestionnaires hôteliers, Californie | Faute intentionnelle : les gestionnaires hôteliers ne peuvent plus se protéger par contrat en Californie

  • La Tribune de lHotellerie
  • 29 avril 2025
```html ⚖️ On April 24, 2025, the Supreme Court of California ruled on "New England Country Foods, LLC v. VanLaw Food Products, Inc.," affecting Hotel Management Agreements (HMAs). The Court prohibited limiting liability for intentional wrongful acts, including fiduciary duty breaches, even among experienced commercial parties. This decision enforces an inherent managerial fiduciary duty to hotel owners, thus invalidating typical clauses that exempt managers from liability for indirect, special, consequential, or punitive damages. Such clauses are unenforceable if the manager is accused of conflicts of interest, bad faith management, intentional deception, or systematic disobedience to owner directives. 🏨 ```
Monde | Tourisme britannique : le WTTC* alerte sur un risque de déclin sans action rapide
  • La Tribune de lHotellerie
  • 28 avril 2025
🏖️ The World Travel & Tourism Council (WTTC) reported in 2025 that travel and tourism contributed £286 billion to the UK economy in 2024, accounting for 10% of GDP. However, international visitor spending was still 5.3% below pre-crisis levels, causing a £2.2 billion loss. The WTTC criticized the UK for policy decisions that could harm tourism, such as implementing the ETA, eliminating tax-free shopping for tourists, increasing air taxes, and cutting VisitBritain's budget by 40%. These measures are especially detrimental to tourism outside of London, exacerbating regional inequalities.
This measure, resulting from negotiations with social partners and aiming to save between €93 and €140 million annually, is part of the 2025 Finance Law. The application decree is pending, following discussions to reform the "inflationary" apprenticeship training financing as per a November 2024 Igas report.
Présomption de démission d’un salarié protégé : l’inspection du travail doit être saisie
  • ghr.fr
  • 25 avril 2025
📝 In a ruling dated March 6, 2025, the Paris Court of Appeal (CA Paris, Pôle 6 – Chambre 2, RG n° 24/02319) declared the dismissal of a protected employee invalid due to the employer's failure to consult with the labor inspectorate prior to considering the employee's voluntary job abandonment as resignation. This case followed the law (n° 2022-1598) of December 21, 2022, and the decree (n° 2023-275) of April 17, 2023, establishing a "presumption of resignation" process, which requires employer intervention and a 15-day justification period after a formal notice. The court ordered the employee's reinstatement, setting a cautious precedent for handling protected employees' departures despite the absence of a definitive ruling from the Court of Cassation.
