📄 Sophie Primas, spokesperson for the French Government, announced on TF1 on April 23, 2025, that employers hiring apprentices preparing for a diploma level of bac +3 or higher will now have a remaining charge of €750. This measure, resulting from negotiations with social partners and aiming to save between €93 and €140 million annually, is part of the 2025 Finance Law. The application decree is pending, following discussions to reform the "inflationary" apprenticeship training financing as per a November 2024 Igas report.

Présomption de démission d’un salarié protégé : l’inspection du travail doit être saisie

📝 In a ruling dated March 6, 2025, the Paris Court of Appeal (CA Paris, Pôle 6 – Chambre 2, RG n° 24/02319) declared the dismissal of a protected employee invalid due to the employer's failure to consult with the labor inspectorate prior to considering the employee's voluntary job abandonment as resignation. This case followed the law (n° 2022-1598) of December 21, 2022, and the decree (n° 2023-275) of April 17, 2023, establishing a "presumption of resignation" process, which requires employer intervention and a 15-day justification period after a formal notice. The court ordered the employee's reinstatement, setting a cautious precedent for handling protected employees' departures despite the absence of a definitive ruling from the Court of Cassation.

📅 Employers must inform employees of the paid leave period 2 months before it starts and announce the leave order 1 month prior to departure. A recent ruling by the Cour de Cassation on April 9, 2025, case number 23-17.723, asserts that if an employee claims unpaid leave, the employer must prove they facilitated the leave-taking. Employers failing to ensure leave can be taken may face payment for untaken leave and additional damages. GHR Social Department advises employers to notify staff of remaining leave before May's end and encourage them to use it, especially without company carry-over practices.

Rappel important : les établissements de la branche HCR peuvent ouvrir le 1er mai

🍴 In France, Hôtels, Cafés, Restaurants (HCR sector) are allowed to open and employ staff on May 1st, respecting conventional rules. May 1st is typically a mandatory non-working holiday with pay (Code du travail, L3133-4 & L3133-5), but the HCR sector is an exception due to the nature of their services. Since 1997, the national collective agreement for the HCR explicitly permits working on May 1st. Salary implications for HCR employees depend on whether May 1st is a usual business day, closure day, or rest day. Minors generally cannot work on holidays, but there's an exemption for minor apprentices in the HCR sector as per R.3164-2 and L.3164-8 of the Code du travail.

It emphasizes non-discrimination, equal pay, salary evolution after parental leave, work-life balance, equal treatment regardless of work hours, and combating sexual harassment and sexism. Two government labels, the Diversity Label and Gender Equality Label, support attractiveness, with a branch report using relevant indicators to track progress and a CPPNI meeting scheduled before the end of 2025 to further discuss professional equality.

Loi Omnibus CSRD : les modifications et simplifications annoncées

🌐 The European CSRD regulation was adopted in 2023 to support the Green Deal and carbon neutrality by 2050. An Omnibus Law proposed by the European Commission aims to reduce administrative reporting burdens by 25% and save €6.4 billion. The CSRD's initial calendar has been amended, with decisions expected by the European Parliament and Council of Europe in July 2025. Key changes include raising the employee threshold for CSRD applicability from 250 to 1,000, delaying reporting obligations to 2028-2029, revising ESRS to reduce indicators from 1,200, and modifying value chain scope. The proposed Omnibus Law will impact the CSRD, corporate due diligence for human rights and environmental impacts, and taxonomy against greenwashing.

Allégements généraux de cotisations patronales 2025 : le décret d’application est publié

💰 The French Social Security Financing Law for 2025 modifies employer contribution relief with reforms in two stages. The decree from April 4, 2025, outlines reduced rates for health and family allowance contributions and parameters for general employer reductions starting May 1, 2025. The SMIC as of January 1, 2025, is €11.88 per hour or €1801.84 monthly for 151.67 work hours, with monthly thresholds of €4054.14 for health contributions and €5946.07 for family contributions. In 2024, the reduction on health contribution was at 2.5 SMIC (€52,416 annually), but in 2025, it's at 2.25 SMIC (€48,648.60 annually). Family contribution reduction went from 3.5 SMIC (€73,382.40 annually) to 3.3 SMIC (€71,351.28 annually) in 2025. The ceiling for the general reduction of employer contributions is now set at 1.6 SMIC (€34,595.28 annually), and the calculation for reduction Fillon changes on May 1, 2025, with the AT/MP contribution rate increasing from 0.46% to 0.50% and unemployment contributions decreasing from 4.05% to 4%.
