Retour sur la 90e AG de l’Hotrec par François Gauthier | L’urgence digitale

  • ghr.fr
  • 5 mai 2025
🏨 GHR participated in the 90th General Assembly of Hotrec in Oslo from April 28-30, 2025. Key issue: integrating artificial intelligence in the hotel industry. Only one in three hotels in Europe is currently classified, as hotel classification importance declines with guests preferring "experience" from online reviews. Fake reviews jumped from 2.4% in 2018 to 8.6% in 2024, according to TripAdvisor's early 2025 report. Urgency for hotel professionals to manage AI's use of customer reviews, confirming positive and combating fake ones, is emphasized for reputation and AI recommendations.

Taux de cotisation AT/ MP applicables à compter du 1er mai 2025

  • ghr.fr
  • 2 mai 2025
🛑 The 2024 accident at work and occupational disease (AT/MP) contribution rates in France were extended until April 30, 2025, due to late passage of the 2025 social security budget. On April 29, 2025, an order was published setting the AT/MP rates effective May 1, 2025, with no retroactive effect. The 2025 rates are based on the company's 2023 workforce. Companies with fewer than 20 employees follow a collective rate; for 2025, the collective rate for restaurants and similar establishments is set at 2.03% in Haut-Rhin, Bas-Rhin, and Moselle, and 1.85% elsewhere. Individual rates include four additional levies: M1 at 0.18%, M2 at 56%, M3 at 0.19%, and M4 at 0.03%. Personalized rates for 2025 are accessible online for employers.

Apprentissage : un reste à charge employeurs de 750 € pour les niveaux bac +3 ou plus (Gouvernement)

  • ghr.fr
  • 25 avril 2025
📄 Sophie Primas, spokesperson for the French Government, announced on TF1 on April 23, 2025, that employers hiring apprentices preparing for a diploma level of bac +3 or higher will now have a remaining charge of €750. This measure, resulting from negotiations with social partners and aiming to save between €93 and €140 million annually, is part of the 2025 Finance Law. The application decree is pending, following discussions to reform the "inflationary" apprenticeship training financing as per a November 2024 Igas report.

Présomption de démission d’un salarié protégé : l’inspection du travail doit être saisie

  • ghr.fr
  • 25 avril 2025
📝 In a ruling dated March 6, 2025, the Paris Court of Appeal (CA Paris, Pôle 6 – Chambre 2, RG n° 24/02319) declared the dismissal of a protected employee invalid due to the employer's failure to consult with the labor inspectorate prior to considering the employee's voluntary job abandonment as resignation. This case followed the law (n° 2022-1598) of December 21, 2022, and the decree (n° 2023-275) of April 17, 2023, establishing a "presumption of resignation" process, which requires employer intervention and a 15-day justification period after a formal notice. The court ordered the employee's reinstatement, setting a cautious precedent for handling protected employees' departures despite the absence of a definitive ruling from the Court of Cassation.

Congés payés non pris : l’employeur doit prouver qu’il a permis au salarié de les poser !

  • ghr.fr
  • 25 avril 2025
📅 Employers must inform employees of the paid leave period 2 months before it starts and announce the leave order 1 month prior to departure. A recent ruling by the Cour de Cassation on April 9, 2025, case number 23-17.723, asserts that if an employee claims unpaid leave, the employer must prove they facilitated the leave-taking. Employers failing to ensure leave can be taken may face payment for untaken leave and additional damages. GHR Social Department advises employers to notify staff of remaining leave before May's end and encourage them to use it, especially without company carry-over practices.

🛑 If you receive an email in English from Booking indicating a problem during a client's stay, do not click any links and verify the sender's email address must be from an official Booking domain. Compare the reservation name and number with your Property Management System (PMS) information. Due to increasingly sophisticated attacks, human vigilance is the best defense. GHR members should contact for support. For more information, consult the security alert on phishing attempts on Booking.com.

Rappel important : les établissements de la branche HCR peuvent ouvrir le 1er mai

  • ghr.fr
  • 18 avril 2025
🍴 In France, Hôtels, Cafés, Restaurants (HCR sector) are allowed to open and employ staff on May 1st, respecting conventional rules. May 1st is typically a mandatory non-working holiday with pay (Code du travail, L3133-4 & L3133-5), but the HCR sector is an exception due to the nature of their services. Since 1997, the national collective agreement for the HCR explicitly permits working on May 1st. Salary implications for HCR employees depend on whether May 1st is a usual business day, closure day, or rest day. Minors generally cannot work on holidays, but there's an exemption for minor apprentices in the HCR sector as per R.3164-2 and L.3164-8 of the Code du travail.
