French lawyer Marc Barennes from Geradin Partners is involved in a collective action in France, opposing the reintroduction of covert parity clauses by Booking.com, despite a French competition authority decision and the Macron law's prohibition of such clauses. The action also addresses opaque OTA practices, excessive commissions (up to 25%), and a resulting estimated €1.5 billion prejudice for French hoteliers between 2015 and 2024. The collective action began on April 22, 2025, with 10 hoteliers and exceeded 100 by April 25, aiming for thousands before an October tribunal. Similar actions are in preparation in Italy and Portugal, with Spain estimating hoteliers' damages at 2% of annual turnover.
