Implementation procedures were defined by a decree on April 17, 2023, followed by a FAQ titled "Questions-réponses – Présomption de démission en cas d’abandon de poste volontaire du salarié" published on the Ministry of Labor's website on April 18, 2023. Unions have challenged the decree and FAQ in the State Council, seeking annulment and a website update. The Council of State identified the decree merely as an application of the law, not a reform project requiring prior consultation per the 1946 Constitution's Preamble and labor code. Complaints that the law and decree omitted protections from International Labour Organization Convention No. 158 concerning terminations initiated by employers were dismissed as the convention does not cover voluntary job abandonment.
